VIM declares that Presstek's August 7 press release is premature

VIM Technologies Ltd. today corrects the premature press release published August 7, 2009 by Presstek, Inc. 

Presstek's press release ignores that the opinion of the Administrative Law Judge of the International Trade Commission ("ITC"), made public on August 5, 2009, is merely an initial determination, and must be reviewed by the full ITC – and in all likelihood reviewed even further – before any final determination is made.  At this point, there is no order or injunction against VIM, and VIM may continue to import its digital printing plates into the U.S., and VIM's U.S. distributors may continue to sell those plates to their customers.
Further, VIM has already filed a Petition for Review with the ITC, pointing out the numerous serious errors of law and fact in the initial determination that require reversal.  VIM fully expects that the full ITC, reviewing the initial determination, will recognize these errors, will reverse the initial determination, and will conclude that VIM's digital printing plates do not infringe the claims of Presstek's patents.  As a result, VIM fully expects, once the final determination is entered and the ITC review process is complete, that VIM will continue to be able to import its digital printing plates into the U.S., and that its U.S. distributors will continue to be able sell those plates to their customers.
Avigdor Bieber, founder and CEO of VIM, stated, "As intellectual property holders, VIM respects intellectual property rights of others. However, we are confident that we do not infringe any of Presstek's patents, and are certain the full ITC will reach the same conclusion, regardless of the erroneous findings in the initial determination. It is regrettable that Presstek continues to feel the need to harass and intimidate VIM's distributors and customers, rather than trying to compete with us fairly in the marketplace."

Mr. Bieber added, "VIM's digital plates are already welcomed and selected by a continuously growing number of printers for their quality and competitive pricing. VIM's digital plates finally enable printers to return to profitable use of their digital presses. We trust that the digital printing industry will see through Presstek's latest attempt to 'corner the market' and will continue using the VIM plates."
