Zapways Sues Xerox For Breach of Contract Related to Premier Partners

IRVINE, Calif.---Nov. 16, 2001--Zapways.com today announced that it has filed a complaint against Xerox Corp. (XRX) in the United States 7th District Court in White Plains, N.Y. Case No: 01-Civil 10123, Case assigned to George B. Daniel. According to Zapways.com President and CEO Tariq Chaudhary, the suit seeks substantial damages arising out of Xerox's intentional breach of its Strategic Co-destiny Agreement with Zapways. According to Chaudhary, Xerox utilized Zapways technical expertise to create, host and operate a web-based portal for distribution of printing projects amongst Xerox's "Premier Partners'' throughout the world. According to the complaint, Xerox abruptly shifted course and attempted to unilaterally cancel the contract. The Strategic Co-Destiny Agreement executed in October 2000, was reached between the two companies to launch an electronic worldwide web based print exchange.
