QuadTech claim against Q.I. Press Controls denied

Oosterhout - The U.S. lawsuit between Q.I. Press Controls and Quad Tech, Inc., a subsidiary of Quad Graphics, took another step in November in which Q.I. Press Controls won again. This represents the next consecutive step for Q.I. Press Controls in the litigation, in which Quad/Tech has not succeeded in any material way. Q.I. Press Controls is pleased with these results and reports them below. Q.I. Press Controls' first recognition was achieved on April 1, 2010. In the lawsuit, the Pennsylvania court denied Quad/Tech's claim that print control technology sold by Q.I. Press Controls in the United States infringe a patent owned by Quad Tech. That patent, dated 1992, relates to a "markless" colour registration control technology.

Finally, on November 15, 2010, Q.I. Press Controls won against Quad/Tech, which attempted to expand its claims, this time in a whole new lawsuit in California. Quad/Tech first filed a patent infringement claim against Q.I Press Controls in California in May 2010. That claim was the same claim Quad/Tech unsuccessfully tried to file in the Pennsylvania court in April, one month earlier. The Pennsylvania court, however, would not allow that claim, so Quad/Tech travelled to California and filed it there. Then in August, Quad/Tech filed a second patent infringement claim in the same case in the California court. The California court recognized this for what it was, dismissed the first infringement claim, and transferred the second claim to the Pennsylvania court. This brings Quad/Tech back to Pennsylvania, where the pending litigation is currently stayed.

Q.I. Press Controls is satisfied with the favourable rulings it has received in the United States courts and looks forward to complete vindication and victory. In the opinion of Q.I. Press Controls, the litigation brought by Quad/Tech is of no merit and is an affront to the innovative solutions developed by Q.I. Press Controls.
