VIM declares Presstek's September 30 press release is premature

VIM Technologies Ltd. today corrects the premature press release published September 30, 2009 by Presstek, Inc.
Presstek's press release ignores that the International Trade Commission ("ITC") has not made its final determination, and that the ITC specifically has requested that the parties submit briefs addressing the remedy, if any, to be imposed. At this point, there is no order or injunction against VIM, and VIM may continue to import its digital printing plates into the U.S., and VIM's U.S. distributors may continue to sell those plates to their customers.
Further, VIM intends to appeal the final determination of infringement, as well as the ITC's construction of the asserted patent claims, to the United States Court of Appeals for the Federal Circuit. VIM is confident that the Federal Circuit will arrive at the correct construction of the asserted patent claims, and accordingly find that VIM's lithographic printing plates do not infringe those claims. As a result, VIM fully expects, once the appeal process is completed and the Federal Circuit's decisions is entered, VIM will continue to be able to import its digital printing plates into the U.S., and that its U.S. distributors will continue to be able sell those plates to their customers.

However, we are confident that we do not infringe any of Presstek's patents, and that the ITC's finding of infringement, based upon an erroneous claim construction, will be reversed by the Federal Circuit. It is regrettable that Presstek continues to feel the need to harass and intimidate VIM's distributors and customers, rather than trying to compete with us fairly in the marketplace."

VIM's digital plates finally enable printers to return to profitable use of their digital presses. We trust that the digital printing industry will see through Presstek's latest attempt to 'corner the market' and will continue using the VIM plates."
