DuPont Files for Preliminary Injunction Against MacDermid Printing Solutions

WILMINGTON, Del., Oct. 20 -- DuPont has filed a motion for a preliminary injunction to stop MacDermid Printing Solutions, L.L.C. from continued infringement of patents related to DuPont CyrelFAST thermal technology. The motion seeks to stop sales of MacDermid's LAVA thermal processing systems and equipment that are used to thermally develop or process flexographic printing plates, including products marketed by MacDermid under the names MLT and Magma. The DuPont-patented dry thermal technology is used to put color images on a variety of packaging materials such as paper, paperboard, foil, corrugated material, freezer bags and plastic film, among others. "DuPont has a long heritage and commitment to developing sustainable products for this industry," said Barry M. Granger, vice president and general manager, DuPont Imaging Technologies. "To continue to invest in future innovations, we must protect our investment in this technology. Although it's been more than a decade since DuPont sought this form of relief in a patent infringement case, after careful consideration we decided it was essential for protecting our intellectual property." On April 28, 2006, DuPont filed a patent infringement lawsuit in federal court against MacDermid. The suit claims that MacDermid has manufactured, used, offered for sale and sold flexographic plates, including products marketed under the names Magma and MLT, which are covered by a DuPont patent related to thermal flexographic technology. The suit also claims that MacDermid has actively induced others to infringe on another DuPont patent through offers to sell, advertise and promote thermal flexographic printing systems. DuPont is seeking monetary damages and demanding that MacDermid stop further acts of infringement associated with these systems and products. DuPont(TM) CyrelFAST is part of DuPont Imaging Technologies, which provides products for industrial print markets, commercial graphics, textile printing, packaging graphics, signage and electronic displays.
